B2B website and service terms
The terms governing technical assessments, proposals and industrial continuity projects.
Last updated: 16 August 2026 · v2026-08-16
1. B2B scope and formation of contract
These terms are intended solely for businesses and professionals acting in the course of their trade, business or profession. The website and assessment form are informational and do not constitute an offer to sell or an order confirmation.
A project starts only after Custom Solutions has issued a written proposal and the client has accepted it in writing. The proposal and any project-specific terms prevail over these website terms where they differ.
2. Assessment, evidence and technical limits
We assess whether a reasonable commercial alternative exists before recommending reconstruction or manufacture. Photographs and incomplete evidence can start an assessment but do not prove hidden geometry, material identity, condition or long-term performance.
The proposal defines what is being delivered and what is validated. Geometric correspondence, fit-check and qualified functional performance are different scopes and must not be treated as equivalent unless expressly agreed in writing.
Unless expressly accepted in writing after an appropriate assessment, we do not supply parts for safety-critical, life-supporting, pressure, braking, lifting, gas, fuel, medical, certified or otherwise regulated applications.
3. Client materials and confidentiality
The client confirms that it is authorised to provide the part, files, drawings, measurements and other information submitted, and to request their examination, reproduction or adaptation. The client remains responsible for information it supplies and for the final equipment in which a part is used.
We will use technical information received through an assessment or project only to evaluate or carry out that request, subject to legal obligations and the agreed scope. Both parties must protect non-public technical and commercial information received from the other.
4. CAD, documentation and digital assets
Unless a written proposal states otherwise, Custom Solutions retains ownership of CAD models, drawings, reconstruction methods and technical documentation it creates.
Once the agreed fees are paid, the client receives only the limited right to use the delivered work for the part, order or purpose expressly described in the accepted proposal. Any assignment, source-file delivery, reuse or production right must be stated and priced in that proposal.
5. Partners, price and timing
We may use a suitable specialist manufacturing partner where this is necessary for the agreed route. Only the information needed for that project will be shared and the partner must be subject to confidentiality obligations.
Prices, payment terms, deposits, lead times, delivery and validation milestones are stated in the proposal or invoice. Lead times are estimates unless the proposal expressly says otherwise; urgency never removes the need for sufficient evidence and a responsible technical decision.
6. Liability
To the maximum extent permitted by applicable law, Custom Solutions is liable only for direct damage caused by its proven failure in the affected project, capped at the amount paid for that project. It is not liable for indirect or consequential loss, including lost production, lost profit or replacement of a wider assembly.
Nothing in these terms excludes liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct or gross negligence where applicable.
7. Website use, law and disputes
Website content is provided in good faith and may change. It is not a binding technical, regulatory or availability commitment. You must not misuse the website, upload unlawful content or attempt to access private systems or files.
These terms are governed by Belgian law. For B2B disputes, the courts of Brussels have jurisdiction, without prejudice to mandatory law or any project-specific written agreement.
